Macmillan Publishers Australia (“Macmillan”) is committed to protecting your privacy. The following terms and conditions govern the use of this website, your interactions with Macmillan and the collection and use of your personal information by Macmillan.

1. Privacy and Security

Macmillan collects your personal information and usage information to process your transaction, for internal review, or to assist in providing or improving the website and Macmillan’s service, or to share with other people or organisations who assist Macmillan in providing our product to you.  We may also disclose your personal information to a third party or distributor to enable the delivery of goods or services to you. Otherwise we do not disclose personal information unless we are required by law, regulation, an applicable industry code, for safety reasons or where we reasonably believe that you are in breach of these terms and conditions or are engaged in illegal activities.

If you do not want Macmillan to forward commercial information relating to our products or services which Macmillan believes may be of interest to you please opt out by contacting webmaster@panmacmillan.com.au.

Macmillan does not hold your credit/debit card information. This information is directed to SecurePay who ensure the highest security for the processing of your credit/debit card transactions. SecurePay guarantee details will not be used fraudulently.

2. Conditions of Purchase

In ordering from Macmillan it is assumed that you have read, understood and accepted the conditions of purchase as listed below:

Credit/Debit Card Payment:

The customer's card is debited by St George Bank at the time of processing the purchase. After reviewing order details, the customer may opt to proceed to payment. The customer will then be linked to St George Bank. After entering their credit card details (Visa or Mastercard only), the customer receives a message from St George Bank as to the success or failure of their transaction as conveyed to the www.panmacmillan.com.au or www.panmacmillanbookshop.com.au websites.

Macmillan does not have access to card details unless a customer calls Customer Services and asks a member of staff to complete an order on their behalf. In this case the customer's card details will be entered onto the system by Customer Services but the information is not stored by Macmillan.

Data is encrypted for the customer's safety. Macmillan cannot be held responsible for a security failure originated with SecurePay or other suppliers.

(i) Print Books

Macmillan at its sole discretion may rescind acceptance, in whole or in part, of any order containing incorrect information, whether this results from technical malfunction or any other cause, or in cases where the order is in conflict with the conditions of purchase. Items on one order are sent to the same delivery address.

Shipping and Delivery Policy

Macmillan ships goods Australia wide and to New Zealand using a range of carriers. Shipping costs are influenced by the location. Exact shipping costs are calculated in the shopping cart and will be added to the order total before checkout. Total costs of the goods or services offered include all appropriate shipping/handling charges and taxes.

Orders are dispatched within two business days. Shipping times are estimated at between 3-7 business days depending on your location within Australia and 3-10 business days to New Zealand.

PRICING POLICY

All of our prices are in Australian dollars (AUD) and include GST (Goods and Services Tax). Product prices are regularly updated when price changes are received from our suppliers.

Any order originated and processed via the Australian URL is processed in Australian dollars (AUD).

Cancellation

You may cancel your order, in part or in whole, within  24 hours of ordering by contacting us at adscs@alliancedist.com.au or calling +61 2 4390 1300, Monday to Friday 9.00 am to 5.00 pm (AEST). Once you cancel an order any sums due to you will be re-credited to your account within 30 days. If your order has already been shipped, please refer to Returns and Refunds below.

Price and availability information may change without notice. Subject to an order being made on or after publication, if an item increases in price during the period between order and dispatch, Macmillan pays the difference on behalf of the customer.

Returns and Refunds

Refunds and returns are not accepted by Macmillan unless the customer has received an unordered item, or an item damaged in transit, or a faulty item. We aim to provide replacement copies of undelivered or returned items when requested, but Macmillan is only obligated to refund purchase costs. Please note that Macmillan will not refund returns postage and packing charges:

Please do the following:
· Make a note for your reference of the order number and item number/ISBN(s) given on the dispatch form.

· Return the item(s) with the original dispatch note in the original packaging.
 
(ii) Ebooks

Macmillan will email you with confirmation of the receipt and acceptance of your order. Macmillan at its sole discretion may rescind acceptance, in whole or in part, of any order containing incorrect information, whether this results from technical malfunction or any other cause, or in cases where the order is in conflict with the terms and conditions of purchase.

Customers have 30 days from the time of purchase to download an ebook. Ebooks may only be downloaded once but can be transferred on up to 6 devices.

Customers are not entitled to refund or return an ebook. Macmillan will resupply corrupted, incomplete or incorrectly supplied ebooks through www.macmillandigital.com.au if notified within 48 hours of purchase. Macmillan will not resupply an ebook that has been lost due to system failure, accidental deletion or other causes beyond Macmillan’s control. It is the customer’s responsibility, once supplied, to ensure the security and integrity of the ebook files, within the limitations of the licence granted on purchase of the ebook.

SUPPLY

Macmillan reserves the right at its sole discretion not to supply certain customers, or customers in certain countries, or to apply any limitations of quantity or value deemed appropriate.

3. Copyright

Unless otherwise stated, all content appearing on this Macmillan website including text, images, audio, video, computer code and software, as well as Macmillan logos and trademarks, are the copyright and sole property of Macmillan and/or its subsidiaries, affiliates or related companies. Unauthorised use is an infringement of Australian and foreign intellectual property laws.

Except for personal reference, content may not be downloaded, copied, reproduced, republished, modified, posted, sold, reused, translated or distributed in any form or by any means without the prior written permission of Macmillan. If you wish to obtain permission to use material from the website, please contact us at webmaster@panmacmillan.com.au. This excludes the downloading of one copy of an extract from the website on a single computer for personal, non-commercial use, with copyright and proprietary notices. You may download and distribute approved educational supplementary course material as indicated on the websites of Macmillan Education, Macquarie and Palgrave Macmillan.

Due effort has been made to contact copyright holders of material that appears on the website. If we have been unable to contact you, please write to webmaster@panmacmillan.com.au so that we may rectify the position.

Disclaimer of warranties and limitation of liability

This website is provided by Macmillan on an 'as is' and 'as available' basis. Macmillan makes no representations or warranties of any kind, expressed or implied, as to the operation of this website or the information, content, materials or products included on this website. You expressly agree that your use of this website is at your sole risk and all materials and information on the website are for your personal, non-commercial use.

To the full extent permissible by applicable law, Macmillan disclaims all warranties, expressed or implied, including but not limited to merchantability and fitness for a particular purpose. Macmillan does not warrant that this website, its servers, or email sent from Macmillan are free of viruses or warrant its uninterrupted availability. Macmillan will not be liable for any damages of any kind arising from the use of this website, including without limitation direct, indirect, incidental, and consequential damages, and loss of business or profits.

Any links to third party websites on the website, do not constitute an endorsement by Macmillan or imply any control of the third party content by Macmillan.

These terms and conditions are governed by Australian law. Any grievance or dispute is subject to the non-exclusive jurisdiction of the Australian courts.
